Rosie O’Donnell took her disturbing feud against President Donald Trump way too far this week after she weighed in on NBC’s decision to fire longtime “Today” show host Matt Lauer.
“Wow, Matt Lauer was just fired from NBC for ‘inappropriate sexual behavior in the workplace.’ But when will the top executives at NBC & Comcast be fired for putting out so much Fake News. Check out Andy Lack’s past!” Trump wrote on Twitter after the firing, according to Freedom Daily.

Rosie immediately posted a screenshot of Trump’s tweet about Lauer with the words “child rapist” written on it.( as seen above)

However, Rosie is not one to talk about “glass houses” on this issue, as her own daughter recently accused her of assaulting her. Her 19 year-old daughter Chelsea accused Rosie of attacking her with a wine bottle, saying she had it handy “because she was drinking, as she did frequently.”

“It was pretty late at night,” Chelsea said. “A couple of weeks prior, I had gotten a tattoo. [Rosie] had spyware on my phone so she could see pretty much everything I did. She called me into her room and asked me about the tattoo. I denied it. She asked me to take off my clothes — she didn’t know where [the tattoo] was — to show her and I refused.”
“She picked up a wine bottle and started chasing me, trying to take off my clothes. She told me if I didn’t show her, if I tried to leave, that she would hit me with the wine bottle, call the police and tell them that I had attacked her. She was holding it above her head and coming after me in her room,” Chelsea added. “She kept trying to run after me and saying that if she really wanted to she could kill me, she’s that strong.”
“She ended up pulling my shirt up and seeing [the tattoo],” she said. “Then I left. I didn’t see her for the rest of the night.”
While Chelsea admitted that Rosie didn’t hit her, but said, “she came really close … I didn’t go to the police because of who she is. She would have tried to say I was crazy and they just wouldn’t believe me. I felt it was her word against mine and why wouldn’t they believe her over me?”

But I remember way back in 2008 when Hillary was running she said Obama's Birth Certificate was questionable.

I am not wearing that aluminium foil hat that Hillary wears and I didn't have that fall.  I can't blame that on my misinformation from my concussion or Pneumonia, like Hillary does. I am not rich enough to say Oh I didn't do it and hide the paper behind me . hand to my "aide" Huma Abedin while she hands that same Top Secret paper to ISIS and gets away with it.

Hillary Clinton’s 2008 campaign manager Patti Solis Doyle admitted on Twitter and in a cable interview Friday that a Clinton staffer had indeed spread the rumor that President Barack Obama was born outside of the United States.
The admission came after a heated exchange Friday afternoon with Ari Fleischer, George W. Bush’s former spokesman, who was pressing Ms. Doyle for the truth that Mrs. Clinton’s 2008 campaign was responsible for creating a whisper campaign in the press that Mr. Obama was ineligible for the presidency.
Ms. Doyle told Mr. Feischer it was a “lie” that the campaign spread the rumors, but then admitted in the same tweet a 2008 staffer had indeed sent an email spreading the birther conspiracy.
“@AriFleischer I fired the rouge [sic] & I called [Mr. Obama’s campaign manager] @davidplouffe to apologize 4 said rouge,” Ms. Doyle tweeted in response to Mo Elleithee, Ms. Clinton’s former traveling press secretary, who said: “The one rouge staffer who sent an email was fired pretty damn quick.”
Ms. Doyle appeared about an hour later on CNN with Wolf Blitzer to address the issue once again. She denied that Hillary Clinton had started the birther theory — then admitted that someone in the Clinton campaign had, in fact, been involved.
“There was a volunteer coordinator, I believe, in late 2007, I believe, in December, one of our volunteer coordinators in one of the counties in Iowa — I don’t recall whether they were an actual paid staffer, but they did forward an email that promoted the conspiracy,” Ms. Doyle said.

Memos show Clinton camp lines of attack, disarray


WASHINGTON (CNN) -- Sen. Hillary Clinton's one-time chief strategist wanted to attack Sen. Barack Obama for lacking "American roots" during the Democratic primary battle, according to a magazine article set to be published online Monday evening.

"All of these articles about his boyhood in Indonesia and his life in Hawaii are geared towards showing his background is diverse, multicultural and putting that in a new light. Save it for 2050," Mark Penn, then Clinton's chief strategist, wrote in a March 2007 memo, according to an article to be published in the September edition of The Atlantic magazine.
"It also exposes a very strong weakness for him -- his roots to basic American values and culture are at best limited. I cannot imagine America electing a president during a time of war who is not at his center fundamentally American in his thinking and in his values," Penn wrote, according to the article by Joshua Green.
In the Atlantic article, which is based on internal Clinton campaign memos and e-mail messages, Green highlighted bitter fighting among Clinton's staff, writing that her advisers "couldn't execute strategy; they routinely attacked and undermined each other and Clinton never forced a resolution."
The internal communication also suggests that the lack of clear lines of authority within the campaign meant that issues that ultimately led to Clinton's defeat -- her lack of support in the Iowa caucuses, the absence of a strategy to capture delegates after the Super Tuesday primaries and her failure to prepare for a protracted primary fight -- went unaddressed for months, Green wrote.
"What is clear from the internal documents is that Clinton's loss derived not from specific decisions she made but rather from the preponderance of the many she did not make," Green wrote. "Her hesitancy and habit of avoiding hard choices exacted a price that eventually sank her chances at the presidency."
The documents also suggest the Clinton staff remained divided throughout the campaign on whether she should run a positive campaign or attack Obama and her other rivals for the Democratic nomination as being untrustworthy and underqualified, Green wrote.
"Clinton's top advisers never agreed on the answer. Over the course of the campaign, they split into competing factions that drifted in and out of Clinton's favor but always seemed to work at cross purposes. And Clinton herself could never quite decide who was right," he wrote. 
The documents also suggest the Clinton staff remained divided throughout the campaign on whether she should run a positive campaign or attack Obama and her other rivals for the Democratic nomination as being untrustworthy and underqualified, Green wrote.

Howard Wolfson, the 2008 communications director for Hillary Rodham Clinton, has said he will not return for a 2016 presidential campaign. Neither, for that matter, will Neera Tanden, the campaign’s policy director. Ditto for Mark Penn, the chief strategist, and Patti Solis Doyle, the embattled campaign manager.
As core members of a dysfunctional “Team of Rivals,” these top advisers were seared, scattered and, to different degrees, forged by the 2008 experience. Haunted by the failures in management and messaging, they have worked hard to get over their shattered White House dreams and rejection by a Democratic base enamored with Barack Obama. They express their requisite hope that Clinton will run and win, but also their lack of interest in jumping back in.
Clinton, who declined to be interviewed, moved on more quickly than many of her senior staff by going to work for Obama as secretary of state. She refuses to acknowledge the 2016 speculation but has privately suggested that the obstacles to running aren’t exactly insurmountable. “She did tell me once that she was really thinking about Chelsea and [son-in-law] Marc,” said Susie Tompkins Buell, a Democratic donor and friend of Clinton, “and how she didn’t want to disrupt their lives.”
The 2008 campaign did precisely that to many of Hillaryland’s denizens. It was a campaign structure that pitted an “A team” of advisers against one another and created a climate of anxiety as a “B team” of potential outside replacements from the Clintons’ White House and Senate orbits hovered.
Now, as Clinton repositions on issues such as gay marriage, reconnects with donors and crowds out potential rivals, the nearly two dozen veterans interviewed for this article debated who among them could or would come back. That spotlights an overlooked consideration for Clinton: With the former core team apparently intent on staying out, can Clinton rebuild an inner circle capable of running and winning a presidential campaign? Will she reach into the tightknit Obama machine for talent, again borrow from her husband’s brain trust or elevate the understudies?
Philippe Reines, one of those former Senate loyalists who followed her to the State Department and is now a paid spokesman for the former first lady, dismissed speculation about a 2016 run even as he pronounced that Clinton “would be a great president and I would want to help her do that.” He also contacted veterans of the ’08 campaign and urged them to avoid anonymous sniping that would reflect poorly on Clinton, according to several people who’ve been on the receiving end and who took the request as a warning not to criticize her. (Reines denied that he policed anyone’s conversations and insisted that he only encouraged former staffers to put their names to any comments.)
He and other boosters sought to put the lingering leadership concerns to rest by pointing to Clinton’s relatively smooth tenure as secretary of state. But even he acknowledged that running an existing bureaucracy is not analogous to building a billion-dollar campaign. That leaves Clinton with only one model as a reference point if she runs for president in 2016.
“I can go into the plus sides of the theory of the Team of Rivals and the downsides of the theory of the Team of Rivals, but I don’t want to do that,” Solis Doyle said. She explained that the past was too painful and filled with “so many” traumas.
“Yeah,” she added, “PTSD.”
A surprising shift
After Clinton conceded the Democratic nomination in the summer of 2008, the famously aerophobic Howard Wolfson swallowed some anti-anxiety pills and boarded a flight to Britain. While abroad, he also continued to get over his attachment to the Democratic Party.
This was a remarkable development. A former executive director of the congressional committee to elect Democrats, Wolfson was once the driving force of the New York Democratic Party. In 2005, he labeled as traitors the Democratic supporters of Mayor Michael Bloomberg — a social liberal who was then running as a Republican. He successfully helped to lead the effort to quash Bloomberg’s push for nonpartisan elections.
For Wolfson, parties mattered. And Clinton mattered. She was the party’s presumptive nominee and his ticket to the White House.
The fall of 2007 proved especially painful for Wolfson. A disastrous Oct. 30 debate for Clinton in Philadelphia eroded her invincibility. Three days later, Wolfson’s mother, who raised him as a single parent, died at age 62. There were later episodes that led Wolfson to describe the atmosphere as a “toxic bath,” the most infamous of which involved his deputy, Phil Singer, who one day in 2008 stormed out of the war room after screaming obscenities at the Team of Rivals “cabal” from atop a chair.
After Clinton’s concession in June 2008, Wolfson joined Fox News as a contributor. Bloomberg, the self-made billionaire who by then had shed party affiliation altogether to become an independent, was seeking a controversial third term as mayor. In potentially luring Wolfson, Bloomberg’s associates saw an opportunity to both sign a talent and prevent a proven foe from working for mayoral rivals. After returning to the States, Wolfson met with Bloomberg’s right-hand man, Kevin Sheekey, at a midtown pub.

She said she remains close to Tanden and Wolfson, and occasionally bumps into Penn and Grunwald at Sidwell Friends, where their children go to school. She says they are polite to one another. Solis Doyle said that she received a note from Hillary Clinton when her mother died and that she sent a note when Clinton’s mother died.
“I haven’t seen her since, wow, February of ’08, maybe?” she said. “I think this is true of everybody who worked on that campaign, including her. You learn from your mistakes. If she should run again — and again I don’t know — I hope she does. I think she would learn from her mistakes.”
Solis Doyle said that she found the prospect of another Clinton presidential run “even more exciting” this time around. But she expects to be otherwise occupied with her new business ventures. Working for Clinton is not in the picture, she said. “I’m just not doing that.”
She did, however, offer her former mentor one bit of advice.
“She shouldn’t run as a front-runner.”

Subcortical Vascular Dementia  : Commonly known as Binswanger's disease


Binswanger's disease (BD), also called subcortical vascular dementia, is a type of dementia caused by widespread, microscopic areas of damage to the deep layers of white matter in the brain. The damage is the result of the thickening and narrowing (atherosclerosis) of arteries that feed the subcortical areas of the brain. Atherosclerosis (commonly known as "hardening of the arteries") is a systemic process that affects blood vessels throughout the body. It begins late in the fourth decade of life and increases in severity with age. As the arteries become more and more narrowed, the blood supplied by those arteries decreases and brain tissue dies. A characteristic pattern of BD-damaged brain tissue can be seen with modern brain imaging techniques such as CT scans or magnetic resonance imaging (MRI). The symptoms associated with BD are related to the disruption of subcortical neural circuits that control what neuroscientists callexecutive cognitive functioning: short-term memory, organization, mood, the regulation of attention, the ability to act or make decisions, and appropriate behavior. The most characteristic feature of BD is psychomotor slowness - an increase in the length of time it takes, for example, for the fingers to turn the thought of a letter into the shape of a letter on a piece of paper. Other symptoms include forgetfulness (but not as severe as the forgetfulness of Alzheimer's disease), changes in speech, an unsteady gait, clumsiness or frequent falls, changes in personality or mood (most likely in the form of apathy, irritability, and depression), and urinary symptoms that aren't caused by urological disease. Brain imaging, which reveals the characteristic brain lesions of BD, is essential for a positive diagnosis.

There is no specific course of treatment for BD. Treatment is symptomatic. People with depression or anxiety may require antidepressant medications such as the serotonin-specific reuptake inhibitors (SSRI) sertraline or citalopram. Atypical antipsychotic drugs, such as risperidone and olanzapine, can be useful in individuals with agitation and disruptive behavior. Recent drug trials with the drug memantine have shown improved cognition and stabilization of global functioning and behavior. The successful management of hypertension and diabetes can slow the progression of atherosclerosis, and subsequently slow the progress of BD. Because there is no cure, the best treatment is preventive, early in the adult years, by controlling risk factors such as hypertension, diabetes, and smoking.

BD is a progressive disease; there is no cure. Changes may be sudden or gradual and then progress in a stepwise manner. BD can often coexist with Alzheimer's disease. Behaviors that slow the progression of high blood pressure, diabetes, and atherosclerosis -- such as eating a healthy diet and keeping healthy wake/sleep schedules, exercising, and not smoking or drinking too much alcohol -- can also slow the progression of BD.

The National Institute of Neurological Disorders and Stroke (NINDS) conducts research related to BD in its laboratories at the National Institutes of Health (NIH), and also supports additional research through grants to major medical institutions across the country. Much of this research focuses on finding better ways to prevent, treat, and ultimately cure neurological disorders, such as BD.

  • Nerve cells in the brain pass signals among themselves using both electrical current and chemicals. In a seizure, the brain's electricity is not passed in an organized way from one cell to the next, but spreads over a cluster of cells or the whole brain all at once. When only a portion of the brain is involved, the seizures are called partial seizures or focal seizures. These seizures vary tremendously in their effects on the person's movement, sensation or behavior depending on which area of brain is involved.
    Partial Seizures (Focal Seizures)
    Some partial seizures are associated with a change in consciousness, even though the person might appear to be awake and his or her eyes may be open. In this type of seizure, called a complex partial seizure, the affected person is unaware of the people nearby during the event, is not aware of his or her own movements or behaviors during the seizure, and does not remember the seizure after it occurs. When the person having a partial seizure is aware of having a seizure, is aware of his or her surroundings and remembers the event afterward, the seizure is classified as a simple partial seizure.
    Sometimes a seizure may begin as a partial seizure but change part way through the event to involve the whole brain in the seizure activity, ending with arm and leg movements on both sides and loss of consciousness. When this happens, it is called a generalized seizure. A person who has seizures repeatedly is said to have epilepsy. In 70% of cases, the cause of epilepsy cannot be found. Sometimes, epilepsy can be caused by scar tissue or a brain infection that can interfere with the brain's electrical signaling. Scar tissue in the brain can be caused by head injury, tumor, stroke or surgery.




A partial seizure can imitate any type of behavior or sensation that the brain can cause, depending on the part of the brain that the seizure activates. Seizures tend to occur in the same area of brain over and over, so symptoms in one person seem very similar from one time to the next. Examples of the symptoms of partial seizures include:
  • Abrupt jerking muscle movements in an arm or leg
  • Chewing or other mouth or tongue movements, or pulling or fumbling with clothing without a purpose
  • A blank stare with no apparent awareness of one's surroundings




  • A sudden feeling of fear, joy or rage that comes without reason
  • Repeating a phrase or word
  • A change in vision or a hallucination (seeing something that is not real)
  • A sensation of smell or taste, usually unpleasant, that does not come from a real object or food
  • Sudden loss of balance or dizziness
After a seizure, a person may be disoriented for a few minutes.

Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President.

Section 4.

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

Plaintiff, by its attorneys Garvey Schubert Barer, hereby complains of the Defendant and alleges:
JURISDICTION AND VENUE
1) Jurisdiction of this Court over Plaintiff’s claims is predicated on 28 U.S.C. § 1332. There is complete diversity of citizenship between Plaintiff and Defendant. Upon information and belief, Plaintiff is sustaining irrrepable injury and financial losses as a result of Defendant’s ongoing breach of the Parties’ Agreement Regarding Use of DNC National Voter File Data (the “Agreement”) that are incapable of precise calculation, but exceed $600,000.00 per day
2) Venue is proper in this District because the Agreement applies the law of the District of Columbia, Defendant is domiciled in this District, and Defendant maintains its principal places of business in this District.
PARTIES
3) At all times hereinafter mentioned, Plaintiff Bernie 2016, Inc. (the “Campaign”) was, and is, a not-for-profit corporation and political organization organized under the laws of the State of Vermont, consistent with the Federal Election Campaign Act of 1971. The Campaign is the election vehicle for 2016 national presidential candidate Bernie Sanders. The Campaign maintains its principal place of business at 131 Church Street, Suite 300, Burlington, Vermont.
4) Upon information and belief, DNC Services Corporation, d/b/a Democratic National Committee (the “DNC”) at all times relevant hereto was, and is, a not-for-profit corporation organized under the laws of the District of Columbia, as the operating body of the United States Democratic Party. Upon information and belief, the DNC maintains its principal place of business at 430 South Capitol Street Southeast, in Washington, District of Columbia.
FACTS
5) On or about October 26, 2015, the Campaign and the DNC entered an agreement captioned “Agreement Between the DNC and Presidential Campaign Committees Regarding use of DNC National Voter File Data” (the “Agreement”). A true and correct copy of the Agreement, with appendices, is annexed hereto as “Exhibit A.”
6) The Agreement establishes a licensing arrangement whereby the Campaign is to be granted limited access to data (“Voter Data”) from the DNC’s voter file, including but not NY_DOCS:607859.1 3 limited to: demographic and geographic data for registered voters (such as name, address and jurisdiction); email addresses; voter registration status; telephone numbers; vote history; commercially acquired consumer data; ethnicity information; political party preference or affiliation, if any; candidate preference data, if any; and other key analytic metrics selected by the DNC.
7) Upon information and belief, the DNC licenses its Voter Data to all candidates for the Democratic Party nomination for the 2016 national presidential election.
8) The Voter Data is hosted by, and accessed via software provided by NGP VAN, a third-party vendor under contract with the DNC.
9) The Voter Data is instrumental to the fundraising efforts of all presidential candidates – but it is especially critical to the Campaign, which has been financed primarily with contributions from individual donors rather than Political Action Committees (“PACs”)
10) In a fundraising drive conducted between December 14, 2015 and December 16, 2015, the Campaign raised more than $2,400,000.00 – or more than $800,000.00 per day. Most of this money came from individual donors identified through, inter alia, the strategic use of Voter Data.
11) The DNC is one of the most powerful political apparatuses in the nation. Candidates seeking the nomination of the Democratic Party for public office rely heavily on the support of the DNC to organize and publicize their campaigns.
12) The loss of DNC support could significantly disadvantage, if not cripple, a Democratic candidate’s campaign for public office.
13) In view of the national political importance of the Campaign -- and by extension, the importance of the Voter Data and the Agreement -- the Agreement substantially restricts both Parties’ rights of termination to cases of prolonged and voluntary breach. The Agreement states, in relevant part:
Either party may terminate this Agreement in the event that the other party breaches this Agreement; the non-breaching party sends written notice to the breaching party describing the breach; and the breaching party does not cure the breach to the satisfaction of the non-breaching party within ten (10) calendar days following its receipt of such notice.
Exhibit A., ¶ 6(b) (emphasis added).
14) The Agreement does not permit either Party to suspend its performance of the Agreement prior to terminating the Agreement in accordance with the provision above.
15) The Agreement does not permit either Party to terminate or suspend the Agreement without notice, or without providing the breaching Party with the requisite opportunity to cure.
16) The Agreement requires the DNC to “use security measures, with respect to the Campaign Data, that are consistent with good practices in the data processing industry.”
Agreement, ¶ 3(f).   Under the Agreement, the DNC warrants that its services shall “be performed in a professional and workmanlike manner, consistent with industry standards in the data processing industry.” Agreement, ¶ 8.
17) The Agreement further requires the DNC to “take all measures necessary to protect the secrecy of, and to avoid disclosure and unauthorized use of” confidential information disclosed by the Campaign to the DNC (“Confidential Information”). Agreement, ¶ 7(a). Pursuant to the Agreement, the DNC undertakes to “immediately notify the Campaign in the event of any unauthorized use or disclosure of the [Campaign’s] Confidential Information including the full extent of the time, place and manner of the use or disclosure and the corrective steps taken by the DNC to address the unauthorized use or disclosure.” Id.
18) Upon information and belief, the DNC has executed similar agreements with other candidates’ political campaigns (“Voter Data Agreements”), requiring the DNC to safeguard Confidential Information that might be disclosed by those campaigns. Though the Agreement disclaims that the “DNC may provide its services to other individuals or entities,” the Agreement clearly states that “such other independent services shall in no way impair the DNC’s ability to provide its obligations and services to the Campaign pursuant to this Agreement.” Agreement, ¶ 11 (emphasis added).
19) The Agreement does not obligate the Campaign to maintain specific security measures with respect to Confidential Information, to notify the DNC of security breaches arising in the DNC’s Voter Data systems, or to protect any confidential information inadvertently disclosed to the Campaign by the DNC. 
The Security Incident
20) On the morning of December 16, 2015, NGP VAN released a modification (the “Release”) to the software that the Campaign and other candidates use to access Voter Data.
21) This Release contained a critical security flaw (the “Bug”) that allowed the Campaign and other presidential candidates to view Confidential Information disclosed by competing campaigns.
22) The Bug was resolved within approximately four hours, by the afternoon of December 16, 2015.
23) Upon information and belief, a similar security incident arose with the NGP VAN software during the 2008 national presidential primaries, resulting in the unintentional transmission of Confidential Information to the campaign of Democratic primary candidate Hillary Clinton (the “Prior Incident”).
24) Before the Bug could be resolved, several staff members of the Campaign accessed and viewed Confidential Information (the “Disclosed Information”) that had been disclosed to the DNC by the 2016 campaign of Democratic presidential candidate Hillary Clinton (the “Competing Campaign”).
25) The Campaign staffers who viewed the Disclosed Information were not able to save or copy the Disclosed Information due to restrictions and controls in the NGP VAN software. Most of the staffers exposed to the Disclosed Information viewed the Disclosed Information inadvertently.
26) When the Bug and resulting leak of the Disclosed Information were brought to the attention of senior Campaign staff, the Campaign conducted an internal investigation that revealed that one individual may have repeatedly accessed Disclosed Information. The Campaign immediately terminated this staff member.
27) On December 17, 2015, at approximately 2:47 p.m., the DNC suspended or terminated the Campaign’s Voter Data access. The suspension or termination of the Campaign’s access was undertaken without contractual cause, and in contravention of the Agreement’s termination protocols.
28) The DNC did not send the Campaign any written notice of termination, much less afford the Campaign the contractually required ten-day period in which to cure any default.
29) The Campaign’s inadvertent access of the Disclosed Information did not constitute a breach of any provision of the Agreement. Even assuming, arguendo, that the DNC could prove that Campaign staff intentionally accessed any Disclosed Information, such access would not amount to a breach of the Agreement, or give the DNC cause to suspend or terminate the Agreement.
30) To the extent that the DNC is obligated to protect the Confidential Information of the other campaigns by virtue of Voter Data Agreements separately executed with those campaigns, it is the DNC and not the Campaign that is in breach of those contractual duties. The Campaign should not be punished for the carelessness of the DNC and its third-party vendor.
31) Whatever duties the DNC may have to protect the Confidential Information of the Competing Campaign, the DNC’s Agreement with the Campaign clearly states that these obligations “shall in no way impair the DNC’s ability to provide its obligations and services to the Campaign pursuant to this Agreement.” Agreement, ¶ 12.
32) The DNC may not suspend the Campaign’s access to critical Voter Data out of haste or desperation to clean up after the DNC’s own mistakes.
33) Upon information and belief, no action was taken in response to the Prior Incident in 2008, nor was any candidate’s access to Voter Data suspended as a result of that Incident.
34) Upon information and belief, the Campaign’s own Confidential Information might have also been compromised by virtue of the Bug in the December 16 Release.
35) The Campaign is hamstrung without access to the Voter Data. With each passing day, the Campaign loses critical fundraising and publicity opportunities.
36) The financial damage caused by the loss of donations is estimated to be approximately $600,000.00 per day. However the damage to the Campaign’s political viability, as a result of being unable to communicate with constituents and voters, is far more severe, and incapable of measurement. 
37) The DNC’s unwarranted, unilateral suspension of the Campaign’s Voter Data access directly impacts one of the nation’s most important electoral races, and carries political implications on a national scale. The DNC should not be permitted to tip the scales of the Democratic presidential primary without clear justification and contractual cause. The fairness of this pivotal national election should not be compromised because of security flaws introduced by the DNC and its vendor.
FIRST CLAIM (Breach of Contract – Specific Performance)
38) Plaintiff repeats and realleges paragraphs 1 through 37 above as if fully set forth herein.
39) The Agreement requires Defendant to implement best practices and reasonable data security to protect Confidential Information and data submitted by the Campaign and the Competing Campaign.
40) Defendant has failed to implement reasonable data security measures, resulting in the inadvertent disclosure of the Competing Campaign’s Confidential Information. Upon information and belief, the Plaintiff’s Confidential Information has also been disclosed.
41) The Agreement prevents Defendant from suspending or impairing its performance under the Agreement, even if ostensibly necessary for the purpose of providing other Voter Data services to other campaigns.
42) Defendant has wrongly suspended and impaired its performance of its Agreement with Plaintiff to mitigate damage caused by its own breach of Voter Data Agreements entered with other campaigns.
43) The Agreement does not permit the Defendant to suspend or terminate service to Plaintiff in the absence of ten days’ written notice to Plaintiff, and Plaintiff’s failure to cure any breach or default within a period of ten days.
44) Defendant has wrongfully suspended the Plaintiff’s Voter Data access without providing the contractually required notice, without identifying any breach of the Agreement by Plaintiff, and without affording Plaintiff any opportunity to rectify any alleged breach.
45) In view of the foregoing, Plaintiff continues to incur substantial financial, reputational and political injury.
46) As a not-for-profit electoral organization with political objectives, Plaintiff’s loss of funds and publicity is not compensable with damages. Plaintiff has no adequate remedy at law.
47) Plaintiff intends to request a temporary restraining order at its earliest available opportunity, mandating that Defendant restore the Campaign’s access to the Voter Data system, pursuant to the terms of the Parties’ Agreement.

SECOND CLAIM (Negligence – Pled in the Alternative)
48) Plaintiff repeats and realleges paragraphs 1 through 47 above as if fully set forth herein.
49) Defendant has failed to exercise reasonable care and diligence in maintaining the security of its Voter Data systems.
50) By virtue of Defendant’s failures of care and diligence, Plaintiff’s access to the Voter Data systems has been suspended or revoked. Upon information and belief, Plaintiff’s Confidential Information has also been compromised.
51) Based on the foregoing, Plaintiff has been injured in an amount to be determined at trial, but known to exceed $75,000.00. 
THIRD CLAIM (Negligent Hiring and Supervision – Pled in the Alternative)
52) Plaintiff repeats and realleges paragraphs 1 through 51 above as if fully set forth herein.
53) Defendant has failed to exercise reasonable care and diligence in delegating maintenance of its Voter Data systems to the third-party vendor NGP VAN.
54) Defendant has failed to exercise reasonable care and diligence in ensuring that the security breaches that occurred during the Prior Incident, under Defendant’s supervision, would not recur.
55) By virtue of Defendant’s negligence, Plaintiff’s access to the Voter Data systems has been suspended or revoked. Upon information and belief, Plaintiff’s Confidential Information has also been compromised.
56) Based on the foregoing, Plaintiff has been injured in an amount to be determined at trial, but known to exceed $75,000.00.
PRAYER FOR RELIEF
WHEREFORE Plaintiff Bernie 2016, Inc. respectfully requests that judgment be entered against Defendant DNC Services Corporation: A. Mandating Defendant’s specific performance of the Parties’ Agreement, and Defendant’s immediate restoration of Plaintiff’s access to the Voter Data system; B. On the second and third causes of action, for damages in an amount determined to be at trial, but presently known to exceed $75,000.00; and C. For such other, further and different relief as the Court deems just and proper.
