Does this mean you can't turn on your radio, no music on your head phones, all sound must be silenced. Does this also mean you can't compose music or sing.Cant watch TV without a permit. I guess all you can do is have sex without sound. Maybe this is why Anthony Weiner is texting his winkie
Fact:
The Department of Homeland Security (An agency enacted through the Patriot Act) is now demanding through enforcement from The State Fire Marshalls that ALL LIVE MUSIC PLAYED IN THE UNITED STATES MUST HAVE A PERMIT FROM THE DEPARTMENT OF HOMELAND SECURITY.
This is an outrage to freedom and the ideals of The American people and our quickly evaporating rights.
This is just the start to the reality of what The Department of Homeland Security is going to do to the American citizens. The DHS is actually saying it is illegal to play music or operate a business where music is played for any reason without paying The Department of Homeland Security, and giving them much personal and private information. If The DHS can regulate the performance of a song where do you think they will stop? The fact is they won’t!
The Department of Homeland Security does not have the jurisdiction to enforce laws in The United States. They have purposefully and misleadingly attached themselves to The Fire Marshall to circumvent American constitutional rights and automatically give themselves jurisdiction in every business in The United States. This is enforced through the Fire Marshall’s inspection of commercial public businesses.
Please stand with me, American Citizens everywhere, and business owners in demanding that we will not allow The Department of Homeland Security in our businesses and homes. We need all US Citizens and our elected officials to stand united against the unlawful abuses of The Department of Homeland Security and this increasingly fascist government. The Patriot Act is the only reason The Department of Homeland Security has any jurisdiction. This is intentional. This is the first bold and aggressive move by them. Please stand with us! Our children and grandchildren need us!
I and my business Folly Moon (a restaurant in downtown Muncie, IN) have a hearing with The Department of Homeland Security at The Indiana State House on Friday Aug. 2nd at 10a.m.
My response to the questions, comments and criticisms about my post “The Department of Homeland Security says it’s Illegal to Play Music in The United States.”
I understand and appreciate the skepticism and debate about my posting about The Department of Homeland Security making it illegal to play music in The United States. Here is a list of the remarks to my post and I will answer each and show the proof of my previous post. Thank you for caring.
1. Is this The State or Federal Department of Homeland Security? I personally am dealing with The Indiana Department of Homeland Security for my hearing on Aug. 2nd, 2013 at 11:00am. This is an Indiana Law. The Indiana Department of Homeland Security is part of the broader Federal Department of Homeland Security. I do not know each state’s Homeland Security Laws or authority with their respective Fire Marshalls. The Indiana Department of Homeland Security is now over The Indiana State Fire Marshall. Attached is their letter head where they are both clearly marked. The State level Departments of Homeland Security report to the Federal Department of Homeland Security making all State level DHS effectively State Agents of The Federal Department of Homeland Security. The DHS came about after the attacks of September, 11 2001. The reason they attach to the State Fire Marshall is because that puts them in EVERY PUBLIC COMMERCIAL BUILDING which means every business in The United States. There is no federal agency with the authority to do that. In fact there are state and federal laws which govern the size and revenue of companies that become under federal jurisdiction. Most of those laws are aimed at keeping the Federal Government out of small business. Which moves on to question 2…
2. Is this required for all buildings? No! Only PUBLIC COMMERCIAL BUILDINGS which means every business in every state that uses the Fire Marshall and Department of Homeland Security together. This means EVERY MUSIC VENUE because all places that play music to the public are COMMERCIAL BUILDINGS. This means every place that is not a private residence is subject to this.
3. Has The Fire Marshall already done an inspection of Folly Moon? Yes! During our Fire Marshall Inspection we were cited for not having an “Amusement & Entertainment Permit”, which according to The Fire Marshall was according to The Department of Homeland Security. Here is a link to the Indiana Code.Note: to find all of the wording I have described in my original post you must also follow the sections that reference another part of the code to read the actual law that is being used. This is a technique used to make it difficult for average citizens or even voting public representatives to understand.
4. Here are the exact codes and the other parts of the codes that the code which I am cited for references.
I am cited on my Fire Marshall report to be in violation of: http://www.in.gov/legislative/ic/2010/title22/ar14/ch3.html
The above code also references these codes to justify it’s authority to carry out this action:Note: to find all of the wording I have described in my original post you must also follow the sections that reference another part of the code to read the actual law that is being used. This is a technique used to make it difficult for average citizens or even voting public representatives to understand.
http://www.in.gov/legislative/ic/code/title22/ar12/ch1.html – What are “regulated places of entertainment” according to DHS and Fire Safety
http://www.in.gov/legislative/ic/code/title22/ar12/ch1.html – What are “outdoor performances”
5. What Info Do they want from business, corporations, llcs, partnerships and building owners (of which no one but the irs gets access to unless you are involved in a lawsuit) IC 22-14-3-3http://www.in.gov/legislative/ic/2010/title22/ar14/ch3.html
Again as applied to The Indiana Department of Homeland Security and enforced through State Firemarshalls it is illegal to play live music in The United States in a COMMERCIAL PUBLIC BUILDING OR OUTDOORS. This law, I believe, if researched is being used in other states also. I do not know because I have not done that research. I have to prepare for my hearing at The Indiana State House with The Department of Homeland Security.
